What a SIMPLE IRA is, and who holds one
A Savings Incentive Match Plan for Employees IRA sits at IRC Section 408(p). Congress designed it so small employers could offer a retirement plan without the paperwork of a 401(k). The employer sets up one SIMPLE IRA account for each participating employee at a qualified financial institution.
Only employers with 100 or fewer employees earning at least 5,000 dollars in the prior year can sponsor a SIMPLE IRA plan. If the employer already offers another qualified plan, they generally cannot run a SIMPLE IRA in the same year. Restaurants, dental offices, small law firms, and family businesses lean on this plan for its light setup.
Employees fund the account through salary reduction contributions taken out of pay. The employer is required to add money too, either as a dollar-for-dollar match up to 3 percent of the employee's compensation, or as a 2 percent nonelective contribution on compensation up to 360,000 dollars for 2026. Every dollar in the account is 100 percent vested from day one, per IRS Publication 4334.
The account itself is a traditional IRA on the custodian's records, coded as a SIMPLE IRA. That coding matters. It controls what can flow in, what can flow out, and when.
Turning a SIMPLE IRA balance into gold
A SIMPLE IRA cannot hold physical bullion directly. A standard SIMPLE IRA custodian will not accept gold coins or bars into the account. To hold IRS-approved metal, the balance has to move to a self-directed IRA whose custodian is a qualified non-bank trustee under IRC Section 408(a).
Under IRC Section 408(m), collectibles held in an IRA are treated as a distribution. Bullion and specific coins that meet a fineness threshold are carved out as a statutory exception at IRC 408(m)(3). Gold must be at least 99.5 percent fine. Silver must be at least 99.9 percent. Platinum and palladium must be at least 99.95 percent. American Gold Eagle and American Silver Eagle coins qualify as statutory exceptions even though the Gold Eagle is 91.67 percent fine.
The metal itself has to sit at an IRS-approved depository. Home storage was tested and rejected in McNulty v. Commissioner, 157 T.C. No. 10 (2021), which treated the metal held at a personal residence as a full distribution plus the applicable early-withdrawal tax.
The flow is straightforward once the 2-year clock is settled. Your SIMPLE IRA balance is transferred to a self-directed IRA. The self-directed custodian pays your chosen gold dealer for approved bullion or coins. The dealer ships the metal to an approved depository under the custodian's name for your benefit. You never touch the metal.
The 2-year rule, and why timing decides the tax bill
The SIMPLE IRA 2-year rule sits at IRC Section 72(t)(6) and is spelled out on the IRS SIMPLE IRA withdrawal and transfer rules page. The clock starts on the date you first participated in your employer's SIMPLE IRA plan. That date is set by your first contribution, not by the day you signed the enrollment form.
During the 2-year window, the only tax-free move you can make is a transfer to another SIMPLE IRA. Rolling to a traditional IRA, a self-directed gold IRA, a 401(k), a 403(b), or a 457(b) is treated as a taxable distribution. The full amount is added to your gross income for the year.
On top of the income tax, the 10 percent additional tax under IRC Section 72(t) is increased to 25 percent for SIMPLE IRAs inside the 2-year window. The 25 percent applies to the same amount you already have to include in income. Standard 72(t) exceptions (age 59 and a half, disability, death, IRS levy, and the others in Publication 590-B) still apply and remove the additional tax.
After the 2-year mark, the SIMPLE IRA behaves like any other traditional IRA on outbound moves. A direct trustee-to-trustee transfer to a self-directed gold IRA is tax-free. A rollover to a Roth IRA is allowed, though the untaxed portion is included in your income for the conversion year.

What can and cannot leave the SIMPLE IRA at each stage

The row that matters most for a gold rollover is the traditional IRA row. Once the 2-year clock ends, that row goes from a 25 percent penalty stack to a clean, zero-cost trustee-to-trustee move.
The 2026 SIMPLE IRA contribution ceilings
Two ceilings apply to what you can put into a SIMPLE IRA each year. Both come from the IRS SIMPLE IRA contribution limits page for tax year 2026.
The employee salary reduction ceiling is 17,000 dollars for 2026, up from 16,500 dollars for 2025. If you are age 50 or older at year-end, you can add a catch-up of 4,000 dollars, for a personal cap of 21,000 dollars. Under SECURE 2.0, a higher catch-up applies for participants who are age 60, 61, 62, or 63 during the calendar year. That higher catch-up is 5,250 dollars for 2026, lifting the age-60-to-63 personal cap to 22,250 dollars.
The employer must add one of two contributions. Option one is a dollar-for-dollar match on the employee's salary reductions, up to 3 percent of that employee's compensation. Option two is a 2 percent nonelective contribution on the first 360,000 dollars of the employee's compensation for 2026, whether the employee defers or not.
An employer can lower the match to as little as 1 percent, but only for 2 out of every 5 years, and must notify employees before the annual 60-day election window.
If you also participate in another employer plan (a 401(k) at a second job, for example), the aggregate salary reduction across all plans is capped at 24,500 dollars for 2026, subject to cost-of-living adjustments.
Rolling a SIMPLE IRA into a gold IRA in six steps
The sequence below assumes your 2-year SIMPLE IRA clock has ended and you want a direct trustee-to-trustee transfer to a self-directed gold IRA. Custodian labels vary; the sequence does not.
- Confirm your 2-year start date with your plan administrator. Ask for written confirmation of the date of your first salary reduction contribution. If that date is more than 24 months ago, the 25 percent additional tax under IRC 72(t)(6) is off the table. If not, restrict the move to another SIMPLE IRA until the clock ends.
- Open a self-directed IRA at a qualified non-bank trustee. Equity Trust Company, STRATA Trust Company, GoldStar Trust, and Kingdom Trust are commonly cited names in the precious-metals space. Code the account as a traditional IRA that will receive an incoming SIMPLE IRA rollover.
- Pick a gold IRA dealer. Your dealer sources the IRS-approved bullion and coordinates with your custodian on payment and shipping. Ask the dealer which self-directed custodians they routinely work with before you sign paperwork.
- Request a direct trustee-to-trustee transfer from the SIMPLE IRA custodian. The receiving self-directed custodian sends the transfer request. The SIMPLE IRA custodian wires the cash directly to the new account. Nothing lands in your bank account. Nothing is reported on Form 1099-R as a distribution.
- Place the metal order once cash is in the self-directed IRA. Instruct the custodian to pay the dealer for bullion or coins meeting the IRC 408(m)(3) fineness rules. The dealer ships directly to an IRS-approved depository, including private vaults like Delaware Depository or the state-run Texas Bullion Depository through Equity Trust Company.
- Confirm depository entry and designate beneficiaries. The depository issues a receipt to the custodian. The metal appears on your next self-directed IRA statement. Complete the beneficiary form at the new custodian. Keep the SIMPLE IRA custodian's rollover confirmation letter with your tax records.
What Texas changes
Federal SIMPLE IRA rules apply the same in every state. Texas changes the wrapper around them.
Texas has no state personal income tax under Article 8, Section 24 of the Texas Constitution. The 25 percent additional tax under IRC 72(t)(6), the ordinary income tax on a botched inside-the-window rollover, or the ordinary income tax on any future required minimum distribution is federal only. A California resident on the same rollover would stack up to a 13.3 percent state layer on top of the same federal numbers.
Texas also offers an in-state storage option that no other state runs. The Texas Bullion Depository is an agency of the State of Texas, authorized by HB 483 signed by Governor Greg Abbott on June 12, 2015. It has operated since 2017 on a purpose-built campus in Leander, Texas, north of Austin, under a contract with Lone Star Tangible Assets.
The depository accepts gold, silver, platinum, palladium, and rhodium. Lone Star Tangible Assets received IRS Nonbank Trustee status in 2023, which opened the door to storing IRA assets at the depository. Equity Trust Company is the first self-directed IRA custodian coordinating with the Texas Bullion Depository for precious-metals IRAs, per the depository's own IRA storage services page.
For a Texan rolling a SIMPLE IRA into gold, the practical takeaway is simple. Once the 2-year clock ends, the federal move to a self-directed gold IRA is tax-free. Texas adds no state income tax on that move or on any future distribution. And the physical metal can sit inside Texas at a state-audited depository rather than out of state. None of that fixes a rollover attempted inside the 2-year window.

A SIMPLE IRA-to-gold rollover is not the right move for every Texan. The failure patterns repeat. We list them here with no CTA attached.
Your 2-year clock has not ended. This is the single most expensive mistake in this whole topic. Inside the window, the only clean move is a transfer to another SIMPLE IRA. Any other destination is a taxable distribution with a 25 percent surcharge under IRC 72(t)(6). If the clock ends in 5 months, wait 5 months.
You expect cash-flow needs before age 59 and a half. A gold IRA cannot be tapped for participant loans. An in-service withdrawal counts as a taxable distribution and adds the 10 percent additional tax if you are under 59 and a half and no exception fits.
Your balance is small and your fee stack is flat. A first-year 12,000 dollar rollover facing 250 dollars in annual custodian fees plus 150 dollars in storage carries a 3.33 percent operating drag before any dealer markup. That drag can outrun the tax benefit for years. Model the fee curve at the balance you actually have.
The dealer is pushing proof coins, graded coins, or exclusive coins. Wide markups on non-bullion coins are the most reliable way to make a SIMPLE-IRA-to-gold rollover underperform. Common bullion coins and bars carry tighter spreads over spot.
You want the metal at home. The IRA cannot hold metal at your house. McNulty v. Commissioner (T.C. 2021) treated a home-stored IRA position as a full distribution, plus the applicable early-withdrawal tax.
You have not compared destinations. After the 2-year mark, a SIMPLE IRA can also roll into a 401(k), 403(b), 457(b), or a low-fee traditional IRA holding index funds. A rollover to gold is one of several options, not the only one. Sit with the trade-offs before you sign paperwork.
You are chasing a conversion narrative. Converting to a Roth after the 2-year mark is allowed, but the untaxed portion joins your ordinary income for the conversion year and can push you into IRMAA brackets on Medicare Parts B and D. Do not convert without running the numbers with a CPA.

How do I know when my 2-year clock ends?
Ask your plan administrator for written confirmation of the date of your first salary reduction contribution to the SIMPLE IRA. That date starts the clock. The clock ends 24 months later. If your first contribution posted on August 1, 2024, your 2-year mark is August 1, 2026. Rollovers to a gold IRA on or after that date are eligible for tax-free treatment.
